Dear RELANC Members,

As you may know, Proposed 2026 Formal Ethics Opinion 1 — Closing Attorney's Referral to Law Partner's Title Insurance Agency — is currently before a subcommittee of the NC State Bar Ethics Committee. The opinion addresses four specific inquiries:

  • Inquiry 1: May a real estate lawyer own a financial interest in a title company?
  • Inquiry 2: May that lawyer recommend and prepare a title opinion for that title company when serving as closing attorney for a client?
  • Inquiry 3: May that lawyer's law firm partner refer a client to the same title company and prepare a title opinion in connection with obtaining title insurance through it?
  • Inquiry 4: Does the answer to Inquiry 3 change if the referring attorney is an associate rather than a partner?

The RELANC Board has taken an institutional position supporting this opinion, but we recognize that our members may hold a range of views — and we want to hear them. We are hosting a members-only Town Hall listening session on Tuesday, June 24 at 5:30 p.m. via Zoom. This is your opportunity to share your perspective in a private forum with fellow members.

All members are welcome to attend and listen. This is the registration page. Upon registration, you will receive a unique Zoom link for the call.

In the interest of time and to ensure that as many voices as possible are heard, speakers will be asked to limit their comments to (proposed: three) minutes.

Not a current member? Lapsed members may renew to participate. Prospective new members are welcome to apply; applications will be reviewed by the Membership Committee on an expedited basis prior to the call.
